民事诉讼证明标准的特性与适用

摘　　要：证明标准是用以衡量通过证据和事实实现心证的程度,或曰用以认定待证事实的证明尺度。由于证明标准表述具有模糊性以及使用证明标准进行事实判断是法官自由心证的结果,所以证明标准具有主观性。证明标准既是认定待证事实存在与否的标准、尺度,也是行为意义上举证证明责任转移与否的标准、尺度。The standard of proof is used to measure the degree of realization of mental proof through evidence and facts,or the standard of proof used to identify facts to be proved.The standard of proof is subjective because the expression of the standard of proof is fuzzy and the use of the standard of proof to judge the fact is the result of the judge’s free evidence.The standard of proof is not only the standard and measure of determining the existence of the facts to be proved,but also the standard and measure of transferring the burden of proof in the sense of behavior.
