论认罪认罚视域下刑事赔偿保证金的实践探索与制度构建

摘　　要：近年来,我国犯罪结构发生较大变化,轻微刑事案件犯罪占比上升,为全面贯彻习近平法治思想,践行以人民为中心的发展理念,落实少捕慎诉慎押和宽严相济刑事政策,我国开始探索建立刑事赔偿保证金制度。刑事赔偿保证金制度的适用有助于进一步推进认罪认罚从宽制度的实施,有效化解社会矛盾,促进诉源治理,实现司法公平正义。但该制度在实践探索中仍面临现实困境,需从加快立法进程、加强释法说理、健全统一规范的提存监管机制、搭建完备的风险防范机制等方面进行完善。In recent years,China has witnessed significant changes in the structure of crime,with the proportion of minor criminal cases increasing.In order to fully implement XI Jinping’s thought of the rule of law,practice the people-centered philosophy of development,and implement the criminal policy of“Less Arrest,More Careful Prosecution and Detention”and“Combining Leniency with Severity”,China has begun to explore the establishment of a criminal compensation deposit system.The application of the criminal compensation deposit system is conducive to further promoting the implementation of the lenient punishment system for confession and punishment,effectively resolving social contradictions,promoting the governance of the source of litigation,and achieving judicial fairness and justice.However,the system still faces practical difficulties in practice and exploration,which needs to be improved from the aspects of accelerating the legislative process,strengthening the interpretation and reasoning,perfecting the unified and standardized deposit supervision mechanism,and establishing a complete risk prevention mechanism.
