摘 要:合同通知解除以其单方面性、便捷性的特点,成为一种较为独特的合同解除方式。为防止解除权被滥用,我国民法典设定了异议权用以对抗解除权,但没有设定明确的异议期限制度。其实,异议期限在司法实践中尚有适用空间。建议重新设立合同通知解除的异议期限制度,增设提出异议的方式。对于异议期限制度下,解除权的实质审查问题,应按通知解除的不同情形而区别对待:对于明显不具有合同解除权这一点如果争议不大的,则即使超过异议期限仍予实质审查并以不具有合同解除权而否定合同解除行为的效力。对于除此之外的其他情形,一旦超过异议期限则不予实质审查,而是以超过异议期限为由确认合同于解除通知到达时解除。The unilateral and convenient nature of contract termination notice has made it a relatively unique method of contract termination.To prevent the abuse of the right of termination,the Civil Code of China has established the right to object as a countermeasure against the right of termination,but a clear objection period system has not yet been set.The author believes that there is still room for the application of the objection period in judicial practice.Therefore,this paper suggests re-establishing the objection period system for contract termination notices and introducing methods for raising objections.Regarding the substantive review of the right of termination in the objection period system,the author puts forward that different situations should be treated accordingly.For cases where there is little dispute over the clear absence of the right of termination,substantive review should still be conducted even after the objection period has expired,and the termination act should be deemed invalid due to the lack of termination rights.For other situations,once the objection period has expired,substantive review should not be conducted,and the contract should be deemed terminated upon receipt of the termination notice due to the expiration of the objection period.
