摘 要:在违法转租的法律关系之中,出租人和次承租人之间不存在直接的合同关系,这在客观上不利于双方权益的保障。承租人对原合同的违反、出租人可能采取的应对措施、次承租人的使用不当等,都可能使得处于违法转租关系中的各方当事人权益受到损害。为了更好地保障当事人的合法权益,便有必要明确违法转租中次承租人的相关权益、出租人解除权的行使以及最终责任的承担问题。In the legal relationship of illegal sublease,there is no direct contract relationship between the lessor and sub-lessee,which is not conducive to the protection of the rights and interests of both parties objectively.Violations of the original contract by the lessee,possible countermeasures taken by the lessor,and improper use by the sublessee may all lead to the infringement of the rights and interests of all parties involved in the illegal sublease relationship.In order to better protect the legitimate rights and interests of the parties,it is necessary to clarify the illegal sub-lessee’s rights and interests,the lessor’s right to discharge the exercise and the ultimate responsibility.
