摘　　要：职业院校混合所有制办学面临的深层次问题在于如何妥善解决产权问题。职业院校混合所有制办学产权作为一种教育产权,体现了产权主体和产权客体之间的权利与义务关系,具有产权主体的多元性、产权结构的复杂性、产权交易的市场性等特征,涵盖了经济产权、知识产权及劳动力产权三个层面。当前,职业院校混合所有制办学在产权主体利益博弈、产权权益分配、产权运营等方面面临一定的风险,而现有立法对混合所有制办学在产权范围、产权归属、产权流转等方面的规定模糊不清,致使职业院校混合所有制办学缺乏完整的法律制度体系保障。因此,今后需要融合公私法理念,构建混合所有制办学产权保护制度,并依据相关法律法规,合理界定产权属性,建立教育产权市场,强化对知识产权的保护,保障师生劳动力产权,推进我国职业院校混合所有制办学的法治化进程。The most fundamental issue in the mixed-ownership operation of vocational colleges lies in how to properly resolve property rights issues.The property rights of mixed-ownership vocational colleges,as a form of educational property rights,reflect the rights and obligations between the subject and object of property rights.It is characterized by the diversity of property right subjects,the complexity of property right structures,and the marketability of property right transactions.It encompasses three dimensions:economic property rights,intellectual property rights,and labor property rights.Currently,mixed-ownership vocational colleges face certain risks in terms of the interest gaming among property right subjects,the distribution of property rights and interests,and property rights operations.The existing legislation on mixed-ownership education,regarding the scope,attribution,and transfer of property rights,is vague and unclear.This lack of clarity has resulted in a lack of a complete legal system to protect mixed-ownership vocational colleges.Therefore,it is necessary to integrate public and private law concepts to construct a property rights protection system for mixed-ownership education in future.Additionally,based on relevant laws and regulations,it is important to reasonably define property rights attributes,establish an educational property rights market,strengthen the protection of intellectual property rights,safeguard the labor property rights of teachers and students,and promote the rule of law in China's mixed-ownership vocational colleges.
