村规民约赋能乡村基层治理:功能、困局及路径

摘　　要：村规民约是中国乡土社会孕育的传统文化,在化解乡邻矛盾、提升基层治理能力、促进基层治理现代化等方面发挥积极作用。现代村规民约历经国家治理与基层自治创新,时代价值愈发明显,但某些仍存在程序不规范、内容不合法、可操作性不强等问题。应坚持村规民约制定主体多元化、程序内容合法化的基本原则,积极完善乡村领域立法,规范乡村行政执法,加强乡村法治宣传教育,提升基层治理能力,促进治理体系现代化,助推乡村振兴战略全面落实。Village regulations,based on the traditional Chinese characteristic rural society,play an active role in resolving conflicts between neighbors,improving grassroots governance capabilities,and promoting the modernization of grassroots governance.The modern village regulations have undergone the evolution of the governance of the country′s public power and the innovative practice of self-governing,and the value of the times has become increasingly prominent.But in practice,there still exist some problems,such as irregular procedures,illegal contents and weak manipuility.On the one hand,it is advised to adhere to the basic principles of the diversification of the subjects,the legalization of the procedure and the content.On the other hand,this paper suggests actively improving rural legislation,standardizing administrative law enforcement,strengthening the education of the law in rural areas and improving the grassroots governance capacity and modernization of the governance system,to comprehensively promote the realization of the rural revitalization strategy.
