摘　　要：近年来兴起的案件繁简分类是程序分类之外新的分类环节,多以智能与人工结合方式划分案件繁简,但运行中存在分类结果失准、人员分配与考评机制不当等理论与实践困境。随着实践发展以及受法院考核影响,多地法院逐渐转变为案由加标的额的简化识别模式,但其内部逻辑已然偏离繁简分流的价值追求。作为“非过程性”司法环节,案件繁简识别的智能模式具有多方面理论支撑,而法社会学理论则推论出两种模式的兼收并蓄。由此,对于司法界的不同期待,长远来看应继续完善智能化分流模式。技术层面可描述法官理性、采纳考核指标、探索高阶技术运用;司法层面可实行繁简识别环节适度推后;配套辅助层面可优化人案配比等,助力在数字时代取得民事案件繁简分流的理想效果。In recent years,the classification of complex and simple cases is a new link in addition to procedure classification.Most cases are divided into complex and simple ones by the combination of intelligence and manual methods,but there are some practical and theoretical difficulties in operation,such as inaccurate classification results,improper personnel allocation and evaluation mechanism.With the development of practice and the influence of court assessment,the courts in many places have gradually changed to the simplified recognition mode of combining the case type and the object of the case.However,the logic of the simplified model has deviated from the value pursuit of recognition of complexity of civil cases.As“non-consequential”judicial activity,the intelligent model has many theoretical supports,and the theory of sociology of law deduces the integration of the two models.Therefore,for the different expectations of the judicial community,we should continue to improve the intelligent mode in the long run.To help achieve the ideal effect of cases classification in the digital era.At the technical level,we can describe the judge’s rationality,adopt the assessment index and explore the application of advanced technology.At the judicial level,the discerning process of complexity can be postponed moderately;At the auxiliary level,we can optimize the ratio of people to cases,etc.
