摘　　要：法治是国家核心竞争力的重要内容。从法理上而言,法治是人类社会最为有效的国家治理方式,它作为一种政治性的国家治理制度安排,强调法律优良、法律至上,为社会提供了常态的运行模式;法治是一种最为经济的国家治理方式,节省了社会运行的资源和成本;法治对国家权力的约束与控制,也为人们的权利自由提供了最大可能的制度空间。法治又是一种讲求平等的国家治理方式,平等确保了每个人独立自主的法律地位,从而为人们发展自我、展现才能提供了法律保障;通过机会平等的保障,人们可以平等地参与国家和社会生活、贡献自己的聪明才智;通过法治来确保人与人之间的平等,也让人们集合在一起形成社会共识,为国家核心竞争力的提升提供智力支撑。同时,法治还是一种升华人性的国家治理方式,有利于提升人的素质,为国家核心竞争力提供相应的社会基础。在此,法治必须以人的尊严为根本准则,确保和培养人们的自尊;正确处理人的自然性和社会性、人的恶本性和善本性、人的自利性和利他性,通过公民教育来促成人性的升华,提高全社会的道德水平。The rule of law is an important part of a nation's core competitiveness.From the jurisprudential aspect,the rule of law represents the most effective form of national governance in human society,which,as a political institutional arrangement for national governance that emphasises the superiority of law and the supremacy of law to provide a stable operating mode for society.The rule of law is one of the most economical governance method,which reduces resources and costs burdens for the functioning of society.Its constraints of state power also provide the greatest possible institutional space for the rights and freedoms of the people.It is also a form of governance method that emphasizes equality,which ensures independent and autonomous legal status of each individual,thus providing legal safeguards for the development of people's selves and the display of their talent.Through the guarantee of equal opportunities,people can equally participate in national and social life and contribute their wisdom and talents.The rule of law is used to ensure equality among people,and also to bring people together to form a social consensus and provide intellectual support for the improvement of the national core competitiveness.At the same time,the rule of law is also a way of national governance that sublimates humanity,which is conducive to improving people's quality and providing a corresponding social foundation for the national core competitiveness.Thus,the rule of law must take human dignity as its fundamental principle,ensure and cultivate people's self-esteem;correctly handle people's naturalness and sociality,people's evil nature and good nature,people's selfishness and altruism,promote the sublimation of human nature through civic education,and improve the moral level of the whole society.
