摘　　要：版权制度的约束导致大量文化遗产不能实现活化利用,也阻碍了文化遗产机构文化传承功能的发挥。在文化遗产数字传承模式下掀起的开放式访问运动,提倡构建更加灵活的版权授权规则和共享机制,实现对文化遗产数字资源的传播和利用。开放式访问运动理念与我国文化数字化发展战略规划相契合,具有一定的借鉴意义。实现全面的开放式访问,应当依托公共文化机构的职能发挥,完善版权立法,确保公有领域作品高质量全面开放共享,允许对孤儿作品开放使用,加强对传统知识保护利用的专门立法。通过加强配套制度建设,在充分保障精神权利与惠益分享、加强技术措施与对话磋商的前提下实现文化遗产数字资源开放共享。The constraints of the copyright system have resulted in a large amount of cultural heritage not being able to achieve adaptive use,and have also hindered the performance of the cultural heritage institutions'cultural transmission function.The Open Glams movement,which was initiated under the cultural heritage digital inheritance model,advocates the construction of more flexible copyright authorization rules and sharing mechanisms to realize the dissemination and utilization of cultural heritage digital resources.The concept of open access movement is in line with China's strategic plan for cultural digital development,and has certain reference significance.To realize comprehensive open access,we should rely on the functions of public cultural institutions,improve copyright legislation,ensure high-quality and comprehensive open sharing of works in the public domain,allow open access to orphan works and strengthen specialized legislation for the protection and use of traditional knowledge and artistic works.Through the strengthening of supporting systems,open access to cultural heritage digital resources should be realized on the premise of fully guaranteeing moral rights and benefit-sharing,and strengthening technical measures and dialogue and consultation.
