摘　　要：关于合同法的司法裁判,应顺应合同法的法律发展而进步,站在新时代,对法律发展与裁判进步的思考是具有时代意义的。以合同法为主视角,探索我国的法律发展与裁判进步,探究我国合同法的变迁,基于合同法的发展思考与合同法发展相对应的司法裁判。司法裁判要正视并合理控制法学方法的非理性因素,司法裁判者的法律观念及对合同法的解读必须与时俱进。Judicial decisions on contract law should advance in tandem with the development of contract law itself.From the perspective of the new era,it is of contemporary significance to consider the evolution of law and the progress of judicial decisions.Focusing on contract law,this paper explores the development of law and judicial advancements in China,examining the changes in Chinese contract law and reflecting on judicial decisions that correspond with these developments.Judicial decisions must acknowledge and rationally control the irrational factors inherent in legal methodologies.The legal perspectives and interpretations of contract law by judges must also keep pace with the times.
