少捕慎诉慎押视角下帮助信息网络犯罪活动罪治理研究  

Research on the Governance of the Crime of Assisting Information Network Criminal Activities from the Perspective of Cautious Arrest,Prosecution,and Detention

摘　　要：如何落实少捕慎诉慎押刑事政策要求,降低审前羁押率、扩大相对不起诉适用是当前帮助信息网络犯罪活动罪治理的重点和难点。通过对2986个起诉书样本和583个不起诉书样本进行分析,审前羁押方面,帮信罪治理存在审前羁押率较高、逮捕条件适用存在偏差、强制措施变更不及时的问题;相对不起诉适用方面,还存在不起诉率较低、裁量标准尚不统一的问题,不同的裁量情节对相对不起诉的影响程度从小到大依次是被告人的犯罪数额、偶犯、自首、悔罪、坦白、退赃退赔、初犯和在校学生身份,而被告人认罪认罚对相对不起诉的影响不大。对此,应当坚持权利保障的轻罪治理观,全面、动态地把握帮信罪犯罪嫌疑人、被告人的逮捕社会危险性,促进其他非羁押性措施的完善;探索建立细化统一的裁量标准以强化相对不起诉的出罪力度。To implement the“cautious arrest,prosecution and detention”policy,reducing pretrial detention rate and expanding the scope of relative non-prosecution are key challenges in addressing the crime of assisting information network criminal activities.An analysis of 2,986 prosecution samples and 583 non-prosecution samples reveals several issues:high pretrial detention rate,deviations in the application of arrest conditions,and untimely changes in compulsory measures.Regarding relative non-prosecution,there are problems such as low non-prosecution rate and inconsistent standards.Factors influencing relative non-prosecution,from least to most significant,include the amount of money involved,casual offender,voluntary surrender,remorse,confession,restitution,first offender,and student offender,while plea bargain has minimal impact.To address these issues,it is essential to uphold the concept of minor crime management with a focus on safeguarding rights,comprehensively and dynamically assess the social danger posed by suspects in assisting information network criminal activities,and promote measures other than custody.Additionally,efforts should be made to establish detailed and unified standards to promote the application of relative non-prosecution.
