摘 要:“大一统”不仅构成了传统中国政治的文明基因,更构成了中国政治的文明宪法。历史上“大一统”思想成熟的理论构建主要体现在以汉代春秋公羊学为代表的经学中,天命是政治合法性的神圣根基,王道是政治体的核心价值认同,天下是华夏政治文明的最高合法性诉求。传统中国宪制文明在现代转化中,更应从传承“大一统”的规范法理内涵入手。传统“大一统”学说在现代中国政治合法性理论构建中的作用与意义,应该建立在对现代西方自由民主政治合法性的充分批判反思的基础上,接续传承“大一统”中华政治文明的精髓,结合现代中国政治的具体情境,构建以中华文明为中心的现代中国政治合法性理论。“Great unification”( 大一统) not only constitutes the civilized gene of traditional Chinese politics,but also the civilized constitution of Chinese politics.In the history,the mature theoretical construction of the thought of “great unification” is mainly reflected in the classics represented by Gongyang School(公羊学)of Han Dynasty.Mandate of Heaven( 天命) is the sacred foundation of political legitimacy,Doctrine of Kingcraft( 王道) is the core value of political identification,and Tianxia( 天下) is the highest legitimate demand of Chinese political civilization.In the modern transformation of traditional Chinese constitutional civilization,we should start first from the normative legal connotation of “great unification”.Basing on the full criticism on the legitimacy of modern western liberal and democratic politics,the role and significance of the traditional “great unification” theory in the construction of modern China's political legitimacy theory should not only continue to inherit the essence of the “great unification” of Chinese political civilization,but also combine with the specific situation of modern Chinese politics.
