摘　　要：中国古代“礼法合治”思想的本质是在治国理政中注重礼与法、德与刑的结合。“礼法合治”思想作为中华优秀传统法治文化的重要组成部分,有着丰富的历史内涵与特质,是治国理政的重要依据,展示中国式法治现代化的中国逻辑与中国特色。该文从中国古代“礼法合治”的内涵出发,阐述其发展演进过程,探讨中国古代“礼法合治”思想的主要内容,其主要是通过发挥道德教化这一精神实质的作用,将德礼与法刑相结合,既坚持德礼为主,又以法刑为辅。该文旨在进一步挖掘中国古代“礼法合治”的精神实质,为现代法治及相关研究提供有益的启示。The essence of the ancient Chinese concept of"combining ritual and law"is to emphasize the combination of ritual and law,as well as morality and punishment in governing the country.As an important component of China's excellent traditional rule of law culture,the concept of"the integration of propriety and law"has rich historical connotations and characteristics.It is an important basis for governing the country and showcasing the Chinese logic and characteristics of modernization of the Chinese style rule of law.This article starts from the connotation of"the integration of ritual and law"in ancient China,elaborates on its development and evolution process,and explores the main content of the ancient Chinese thought of"the integration of ritual and law".It mainly combines moral education with legal punishment by exerting the spiritual essence of moral education,adhering to the principle of morality and propriety as the main focus and supplemented by legal punishment.This article aims to further explore the spiritual essence of the ancient Chinese concept of"the integration of ritual and law",and provide useful insights for modern rule of law and related research.
