摘 要:传统金融消费者保护理论预设金融消费者天然弱势地位,依公平理念和强行政干预调节主体间的利益失衡,多存在僵化片面之局限。法律与金融作为社会系统的重要组成部分,既存在内在的封闭独立性,亦存在外部沟通可行性,依系统论可通过符码化和纲要化形成法律系统与金融系统的耦合,构建从“弱势消费者”到“利益相关者”的权利体系并对政府干预进行动态重塑。对此,金融消费者保护应坚持从“全面保护”到“适度保护”的理念转化,以权利为导向,细化金融机构义务履行规则,尤应注重互联网金融规则的特殊设计。Traditional financial consumer rights protection theory is based on the natural disadvantaged position of financial consumers,and adjusts the imbalance of interests between transaction subjects according to the concept of equality and strong administrative intervention,but most of them have the limitations of rigidness and lopsidedness.As an important part of the social system,law and finance both have inherent independence,as well as the feasibility of external communication.From the perspective of system theory,the coupling of legal system and financial system can be formed by the means of coding and programming,so as to build a rights system from"weak consumers"to"stakeholders"and to dynamically reshape the government's appropriate intervention.Therefore,the improvement of financial consumer protection should adhere to the transformation of the concept from"comprehensive protection"to"appropriate protection",and be guided by rights to refine the rules for the implementation of obligations of financial institutions.In particular,special attention should be paid to the special design of Internet financial rules.
