摘 要:《民事强制执行法(草案)》第六条规定了信息科技原则。该原则具有重要的实践指导意义与时代意义,对于推进执行措施现代化具有重要价值,有必要在《民事强制执行法》中予以确立。在多地法院大力推进智慧执行的背景下,目前,智慧执行体系仍存在智慧执行规定不够明晰、数字化支撑较弱、地方局限性较大、未实现信息共享、个人信息保护不足等困境。通过完善执行系统、联动执行机构、规范执行流程、限制执行底线,可以准确有效地划定执行范围,实现执行数据部分共享,促进执行过程数字化、透明化,由此得以贯彻信息科技原则的要求,回应执行体系数字化发展需要,健全我国民事执行体系。Article 6 of Civil Enforcement Law(Draft)stipulates the principle of information technology.This principle has important practical guiding significance and times significance,and has important value for promoting the modernization of enforcement measures,and it is necessary to establish it in the Civil Enforcement Law.In the context of the vigorous promotion of smart enforcement by courts in many places,the current smart enforcement system still has difficulties such as unclear smart enforcement provisions,weak digital support,large local limitations,no information sharing,and insufficient personal information protection.By improving the enforcement system,linking enforcement agencies,standardizing execution process and limiting the bottom line of execution,we can accurately and effectively delimit the scope of execution,realize the partial sharing of execution data,and promote the digitalization and transparency of the execution process.Thus,we can implement the requirements of the information science and technology principles,respond to the digital development needs of the execution system,and perfect the civil execution system in our country.
