摘　　要：伴随Chat GPT为代表的新一代人工智能技术诞生,智能医疗技术的应用将在复杂医疗流程中大量实现自主诊疗决策与诊治控制,其逐步改变了传统医疗的生态与秩序,但也给大众带来一系列医疗隐私风险的挑战,尤其智慧医疗范式的新兴建构势必呼唤高度的数据采集、共享、运用,更加剧了医疗数据使用的不确定性与医疗隐私的风险程度。研究聚焦当前智能医疗的现实应用,关注新一代人工智能引发的潜在的医疗隐私数据风险的路径与样态,探析新一代人工智能带来医疗隐私保护的风险成因与调治困境,提出医疗隐私保护的治理路径——提升安全主导、充实法治供给、加速技术研发、推进风险评估、提升责任意识。With the emergence of a new generation of artificial intelligence technology represented by ChatGPT,the application of intelligent medical technology will significantly realize autonomous diagnosis and treatment decision-making and control in complex medical procedures.This gradually changes the ecology and order of traditional healthcare,but also poses a series of challenges to medical privacy risks for the general public.Especially the emerging construction of smart healthcare paradigms inevitably calls for a high degree of data collection,sharing,and utilization,further increasing the uncertainty of medical data usage and the risk level of medical privacy.The research focuses on the current practical application of intelligent healthcare,pays attention to the potential paths and forms of medical privacy data risks caused by the new generation of artificial intelligence,analyzes the causes of medical privacy protection risks and the difficulties in governance brought by the new generation of artificial intelligence,and proposes governance paths for medical privacy protectionimproving security leadership,enriching the supply of the rule of law,accelerating technological research and development,promoting risk assessment,and enhancing awareness of responsibility.
