法文化视域下海南民族地区社会治理研究

摘　　要：在海南自由贸易港(以下简称自由贸易港)建设中,民族地区法文化活态和社会治理机制的探讨将为自由贸易港建设提供重要的法律资源和可靠的法律制度保障。海南是一个多民族聚居的省份,现有乐东、陵水、昌江、保亭、琼中、白沙6个民族自治县,这6个县拥有大量少数民族聚居区;此外五指山市、东方市、三亚市均有比较集中的少数民族聚居区。以黎族、苗族、回族为代表的族群在民族地区大量存在,这些民族地区还存在着隐形的家族组织和一系列的法文化活态,在自由贸易港建设背景下如何处理好民族地区法文化活态与社会治理的关系,对于实现民族地区的“善治”具有重要作用。探究民族地区治理模式、尊重民族传统文化、发挥族群自治功能等路径可以为海南民族地区社会治理提供有力支持。In the construction of Hainan Free Trade Port(hereinafter referred to as the Free Trade Port),the discussion on the legal culture and social governance mechanism in ethnic areas will provide important legal resources and reliable legal system guarantee for the free trade port construction.Hainan,a multi-ethnic province,contains six autonomous counties—Ledong,Lingshui,Changjiang,Baoting,Qiongzhong and Baisha—which are home to a large number of inhabited areas of ethnic minorities.In addition,Wuzhishan City,Dongfang City and Sanya City also have relatively concentrated ethnic inhabited areas.Ethnic groups represented by the Li,Miao and Hui people exist in large numbers in ethnic areas,where there are also invisible family organizations and a series of legal culture activities,so how to handle the relationship between legal and cultural activities as well as social governance in ethnic areas in the context of the free trade port construction is of great importance for realizing“good governance”in ethnic areas.Effective support can be provided for social governance of ethnic areas in Hainan by exploring the governance models in ethnic areas,respecting the traditional ethnic culture,and giving full play to the function of ethnic autonomy.
