摘 要:临时仲裁制度是涉外法治领域中的重要内容。注重涉外法治对健全国内法治的促进作用、贯彻司法支持仲裁理念、平衡公正与效率价值是我国在构建临时仲裁制度当中应遵循的基本逻辑。现阶段,将临时仲裁的适用范围扩大到国内仲裁具有一定的现实需求和市场基础。为构建系统化的临时仲裁制度,不仅需要在立法层面赋予其合法性,创新仲裁员选任规则,建立仲裁员委任机制,还需完善第三方协助机制,健全以司法监督为主的多元化监督体系和责任体系。The ad hoc arbitration system is a key component in the field of foreign-related legal governance.Focusing on the role of foreign-related legal governance in improving domestic legal systems,implementing the judicial support for arbitration concept,and balancing the values of fairness and efficiency are the basic logic that China should follow in establishing an ad hoc arbitration system.At the current stage,there is a practical need and a market and economic basis for expanding the scope of application of ad hoc arbitration to domestic arbitration.To build a systematic ad hoc arbitration system,it is not only necessary to grant it legitimacy at the legislative level,innovate arbitrator appointment rules,and establish the arbitrator appointment mechanism,but also to improve the third-party assistance mechanism,and perfect a diversified supervision system and responsibility system primarily based on judicial supervision.
