新领域虚假诉讼案件民事检察监督研究

摘　　要：近年来,民事诉讼领域虚假诉讼案件的案发率呈逐年上升趋势,涉及的案件领域不断扩大,因虚假诉讼给司法秩序带来的破坏及对司法公信力造成的损害日益加深。当前虚假诉讼行为外观表象合法程序之高、内在违法目的隐匿程度之深,给检察机关查办虚假诉讼案件带来了极高难度和挑战。如何提高检察机关识别虚假诉讼案件的能力、如何运用检察监督手段遏制虚假诉讼行为向各民事诉讼领域蔓延是检察机关在履行监督职能时应先思考的现实问题。对于检察机关而言,通过民事检察监督手段打击、遏制虚假诉讼行为,既应畅通案件来源渠道,还应在履职过程中淬炼过硬的专业本领,加强与法院、公安机关及其他相关单位的沟通协作,形成打击虚假诉讼行为内外畅通之监督合力。In recent years,the incidence rate of false litigation cases in the field of civil litigation has been increasing year by year,with continually expanding areas of involvement.The damage caused by false litigation to judicial order and judicial credibility has become increasingly profound.The high level of apparent legality in the external manifestations of current false litigation behaviors and the deep concealment of their underlying illegal purposes pose significant difficulties and challenges to procuratorial organs in investigating and handling false litigation cases.Enhancing the procuratorial organs'ability to identify false litigation cases and utilizing prosecutorial supervision means to curb the spread of false litigation behaviors into various civil litigation areas are practical issues that procuratorial organs should consider when performing their supervisory functions.For procuratorial organs,combating and curbing false litigation behaviors through civil prosecutorial supervision not only requires unimpeded case sourcing channels but also necessitates refining professional skills in the course of duty,strengthening communication and collaboration with courts,public security organs,and other relevant units,and forming a cohesive force for supervising and combating false litigation behaviors both internally and externally.
