脑机接口技术应用中知情同意权的伦理与法律规制研究

摘　　要：随着脑机接口(BCI)技术研究的不断深入,相关科技伦理与法律规制问题亟待解决。以BCI技术在医疗和娱乐应用中的知情同意权问题为切入口,了解不同用户群体在知情同意过程中的需求差异,探讨用户理解BCI技术的难度及BCI技术对有效知情同意的影响,分析《中华人民共和国民法典》及其他法律规范在BCI技术应用中的适用性,基于BCI应用场景知情同意权保障,提出分层次的知情同意流程、建立动态的监管机制等建议。As the research on brain-computer interface(BCI)technology continues to deepen,the scientific and technological ethical and legal regulation issues related to the application of BCI technology need to be resolved.Taking the issue of informed consent rights in medical and entertainment applications of BCI technology as an entry point,this paper analyzes the differences in the needs of different user groups in the process of informed consent,and discusses the difficulty of users’understanding of BCI technology and its impact on effective informed consent.The applicability of the Civil Code of the People’s Republic of China and other legal norms to the application of BCI technology from the perspective of legal regulation.Based on the protection of informed consent rights in BCI application scenarios,suggestions such as hierarchical informed consent process and establishment of dynamic supervision mechanism are put forward.
