比较视域下我国高校学生资助法治化进路研究

摘　　要：高校学生资助工作对于保障教育机会均等具有重要意义。但是,当前高校学生资助法治化存在法律位阶不高、专门性法律欠缺、政策性色彩浓厚等问题,亟需实现从“政策主导”向“有法可依”转变。文章回顾了我国高校学生资助法治化建设的进程,阐述了部分发达国家教育资助的立法经验,并从强化立法理念、明确法律性质、探索法律形式等方面,对高校学生资助立法和教育资助法律体系的构建进行了探讨。The work of funding for students in colleges and universities is of great significance in ensuring equal educational opportunities.However,there are problems with the legalization of funding for students in colleges and universities currently,such as low legal status,lack of specialized laws and strong policy color.It is urgent to achieve a transition from“policy led”to“legal basis”.The article reviews the process of legalization of funding for students in colleges and universities of China,elaborates on the legislative experience of some developed countries in education funding,explores the legislation of funding for students in colleges and universities,and the construction of legal system for education funding from the aspects of strengthening legislative concepts,clarifying legal nature and exploring legal forms.
