开源社区知识产权治理模式及变革--基于36个开源社区使用协议的考察

摘　　要：开源社区知识产权治理既是完善开源知识产权和法律体系的重要内容,也是开源社区高质量发展的重要支撑。本研究从开源社区使用协议出发,提炼其中的知识产权治理规则,总结开源社区知识产权治理模式及未来变革方向。研究结果表明,开源社区是开放创新体系下的创新组织,在民法意义上属于其他非营利性非法人组织,在科学技术进步法意义上属于创新联合体。开源社区知识产权治理规则主要包括两部分,一是由开源社区管理者和知识贡献者“个人所有”“个人所有+社区所有”以及“个人所有+共同共有”三种模式构成的知识产权归属规则,其模式面临由契约式向章程式的转变;二是由开源许可证、贡献者许可协议和知识共享许可三种使用许可模式构成的知识产权使用规则,在开放式创新模式下迎来以构建权利共享规则重塑开源社区知识产权使用规则的重要转向。The intellectual property governance of the open source community is not only an important content of improving the open source intellectual property and legal system,but also an important support for the high-quality development of the open source community.This study extracts the intellectual property governance rules,summarizes the intellectual property governance model of the open source community and the future change direction from the open source community use protocol.The research results show that the open source community is an innovation organization under the open innovation system,which belongs to other non-profit unincorporated organizations in the sense of Civil Law and an innovation union in the sense of Scientific and Technological Progress Law.The open source community intellectual property governance rules mainly include two parts.First,the intellectual property ownership rules,which are composed of three modes of open source community managers and knowledge contributors:“personal ownership”,“individual ownership+community ownership”and“individual ownership+common ownership”,are facing a change from contract to charter.The second is the intellectual property use rules composed of three licensing modes:open source license,contributor license agreement and intellectual sharing license.Under the open innovation mode,there is an important shift to reshape the rules of intellectual property use in the open source community by building rights-sharing rules.
