摘 要:集体劳动权对解决劳动力市场中的议价失衡问题具有重要工具价值,但该权利的行使必须以劳动关系存在为前提。为了保护非标准劳动关系下的平台从业者,应当打破这种桎梏,对其扩张适用集体劳动权。首先,需要立法厘清定位,通过修改集体劳动法扩大享有该权利的主体范围,通过修改反垄断法拓宽该权利的豁免范围。其次,需要推进组织建设,为这部分平台从业者组建行业性工会组织,利用多种手段提高工会建设水平。最后,还需要明确工会组织的集体谈判重点,包括服务计价与平台抽成、职业安全健康保障、从业者数据信息保护。Influenced by factors such as the broadening of employment options,the strengthening of market dominance,and the effectiveness of digital technology empowerment,the problem of negotiation imbalances in the labor market under the platform economy became increasingly prominent.Collective labor rights have important instrumental value in solving the problem of negotiation imbalances in the labor market,but the exercise of this right must be based on the presence of labor relations.This shackle should be broken,and the collective labor rights should be applied to the platform practitioners under the non-standard labor relations.Firstly,it is necessary to clarify the positioning of legislation,expand the scope of subjects enjoying this right by modifying the collective labor law,and broaden the scope of exemption of this right by modifying the anti-monopoly law.Secondly,it is necessary to promote organizational construction,set up industry unions for the platform practitioners,and accelerate the development of intelligent trade unions by a variety of means.Finally,it is necessary to clarify the key points of collective bargaining of trade unions,including service pricing and platform royalty,occupational health protection,protection of practitioners' data.
