摘　　要：动态平衡是一个哲学范畴,不仅具有理论价值,而且还具有实践工具价值。刑事涉案财物处置权是由主体、客体、对象等要素构成的系统,其与动态平衡具有内在关联。动态平衡能够作为刑事涉案财物处置权运行理论基础的原因在于其揭示了刑事涉案财物处置权产生、运行的本质原因,其是刑事涉案财物处置权存在、运行的内在根据,其还反映了刑事涉案财物处置权有序运行的含义。正是因为动态平衡与刑事涉案财物处置权运行紧密相连,其对刑事涉案财物处置权运行具有启示意义,其不仅表明了刑事涉案财物处置权无序运行的本质,而且指明了纠正刑事涉案财物处置权无序运行的节点,还是刑事涉案财物处置权有序运行的根本方法。Dynamic equilibrium is a philosophical category that not only has theoretical value,but also practical tool value.The power to dispose of property involved in criminal cases is a system composed of elements such as subject,object,and object,which is inherently related to dynamic balance.The reason why dynamic balance can serve as the theoretical basis for the operation of criminal property disposal power is that it reveals the essential reasons for the emergence and operation of criminal property disposal power.It is the internal basis for the existence and operation of criminal property disposal power,and also reflects the meaning of orderly operation of criminal property disposal power.It is precisely because dynamic balance is closely linked to the operation of the power to dispose of criminal property involved that it has enlightening significance for the operation of the power to dispose of criminal property involved.It not only indicates the essence of the disorderly operation of the power to dispose of criminal property involved,but also points out the nodes to correct the disorderly operation of the power to dispose of criminal property involved,and is the fundamental method for the orderly operation of the power to dispose of criminal property involved.
