刑事补充侦查的“理”与“术”

摘　　要：刑事补充侦查之“理”是指理念与方法:一是运用“前理解”对罪与非罪、此罪与彼罪作出预判,在补充侦查中发挥经验常识的作用;二是运用辩证思维排查证据矛盾;三是将融合思维贯穿于具体补证与方法选择。刑事补充侦查之“术”,体现在范围、措施、诉讼阶段等方面:应明确补充侦查的适用范围包括补强犯罪事实、排查证据矛盾、融合侦查监督三个方面;综合适用讯问、询问、调查、勘验、鉴定、电子数据审查等各种措施;明确补充侦查可适用于刑事诉讼各个阶段;最后,应从“理”与“术”两个方面对补充侦查的机制予以完善,强化“捕后诉前”跟踪引导取证,充分发挥补查文书说理、“三查融合”、科技赋能的作用。The"theory"of criminal supplementary investigation refers to the concept and method:Firstly,using"pre-comprehension"to predict crime and non-crime,this crime and that crime,to play the role of experience and common sense in supplementary investigation;Secondly,using dialectical thinking to identify evidence contradictions;The third is to integrate fusion thinking into specific evidence and method selection.The"technique"of criminal supplementary investigation is reflected in the scope,measures,litigation stages,etc.It should be made clear that the scope of application of supplementary investigation includes reinforcing criminal facts,investigating evidence contradictions and integrating investigation supervision;Comprehensively apply various measures such as interrogation,inquiry,investigation,inquisition,appraisal,electronic data review,etc;Clarify that supplementary investigation can be applied to various stages of criminal proceedings;Finally,the mechanism of supplementary investigation should be improved from both the aspects of"theory"and"technique",strengthening the tracking and guidance of evidence collection after arrest and before prosecution,and fully leveraging the role of reasoning in supplementary investigation documents,"integration of three investigations",and technological empowerment.
