论《学前教育法(草案)》“单位办园”的性质——一个关系各级各类学校地位的问题  

On Nature of“Unit Running Kindergartens”in Draft Law on Preschool Education:an Issue Related to legal Status of Schools at All Levels and Types

摘　　要：关于“单位办园”是民办园,还是公办园抑或是公办性质园(在第四和第五大部分有明确定义),不仅在理论上存在两种截然相反的观点,而且在法律上《学前教育法(草案)》与《民办教育促进法》存在着相反的规定。据分析,“单位办园”的主体主要包括企业事业单位、政府其他部门、普通高等学校、人民团体、部队,而未涵盖政府教育部门、街道、村集体。国家所有权主体是确定一所幼儿园为公办园还是民办园的标准。国有财产行使主体的法律规定性、国家所有即全民所有财产的统一性和本质上无差异性,决定“单位办园”属于公办园,而非“公办性质园”。为规范使用幼儿园的认定标准,在使用时应注意采用同一标准或者一致性标准。Not only are there two completely opposite views in theory on whether“the unit’running kindergartens”are the private kindergartens,the public kindergartens,or the public nature kindergartens.but also the Draft of China’s Preschool Education Law and the Promotion Law of the Private Education have made the opposite provisions.According to the analysis,the main subjects of“the unit’running kindergartens”include the enterprises and the institutions,the other government departments,the higher education institutions,the people’s organizations,and the troops,but do not cover the government education departments,the city streets,and the village collectives.The subject of the state ownership is the recognition standard of whether a kindergarten is the public or private kindergarten.The legal provisions of the exercising subjects of the state-owned properties,the unity and the essentially non differentiation of the properties owned by the state,that is,by the whole people,determine that“the unit’running kindergartens”belong to the public kindergartens,rather than"“the public nature kindergarten”.To standardize the use of the kindergarten classification standards,the attention should be paid to using the same or consistent standards.
