浅论民营企业合规发展视野下的附条件不起诉制度

摘　　要：企业合规治理是党的二十大全面依法治国、国家治理体系和治理能力现代化、节约司法资源、实现高质量法治的重要内容和法治建设要求。在此背景下,如何将企业合规附条件不起诉制度与民营企业发展相衔接成为当下的研究重点。因此,文章认为,在涉案民营企业中应充分适用以检察机关牵头、多部门协调的“附条件不起诉”制度,针对民营企业的涉案处理方式也不应当再继续适用之前粗犷式的“一刀切”做法,而更应当在司法领域探求解决路径。Corporate compliance governance is an important part of the 20th National Congress of the Communist Party of China(CPC)to comprehensively govern the country according to law,modernize the national governance system and governance capacity,save judicial resources and achieve high-quality rule of law.In this context,how to connect the conditional non-prosecution system of corporate compliance with the development of private enterprises has become the focus of current research.Therefore,the author believes that the“conditional non-prosecution”system,led by the procuratorate and coordinated by multiple departments,should be fully applied to the private enterprises involved in the case.The handling of cases involving private enterprises should no longer continue to apply the previous crude one-size-fits-all approach instead of exploring solutions in the judicial field.
