摘　　要：监察与刑事诉讼衔接的核心在于证据的衔接。《监察法》的出台为二者在证据衔接方面搭建了基础性框架。但由于相关规定较为粗疏,实践中仍存在一定的理解分歧和适用难题。基于对条规的法教义学分析《,监察法》赋予了监察证据刑事诉讼准入资格,将《刑事诉讼法》纳入监察取证规范渊源,设置了体现监察取证特点的非法证据排除规则,但针对实务中仍然存在的证据种类不一、取证规范差异、审查基准不同等突出问题,两法还需立足于整体的法秩序框架,在兼顾司法规律和监察特性的基础上,寻求价值上趋于合理又协调一致的证据衔接路径,实现监察与刑事司法价值层面的衡平与贯通。The core of coherence between supervision and criminal proceedings is the connection of evidence.The Supervision Law of the People's Republic of China has set up a basic framework for the coherence of evidence between supervision and criminal proceedings.However,due to the relatively careless provisions,there are still some differences in understanding and problems in practice.According to the legal dogmatics,the Supervision Law of the People's Republic of China has endowed the supervision evidence with the qualification of access to criminal proceedings,made the Criminal Procedure Law of the People's Republic of China the legal source of obtaining supervision evidence,and set up the exclusion rules of illegal evidence that show the characteristics of obtaining supervision evidence.However,problems still exist in practice,such as the disparity in the type of evidence,the distinct evidence-obtaining norms and the differences in review criteria.Therefore,it is suggested that these two laws should keep a foothold for the overall framework of legal order,take into account both the judicial principles and the attributes of supervision,and seek a reasonable and coordinated path to the coherence of evidence in terms of value.In this regard,the balance and effective connection between supervision and criminal justice can be realized at the level of value.
