乡村社会中的人民调解实践与反思——基于对云南晓村的调查研究

摘　　要：在社会转型背景下,乡村社会的秩序结构、关系向度、思想意识等正在悄然改变。乡村纠纷解决的方式、机制、模式呈现出与之对应的嬗变,人民调解在乡村社会解决纠纷的过程中发挥了重要作用。文章基于田野调查材料,在社会转型背景下分析乡村人民调解的地方性实践经验及其内在逻辑。乡村人民调解委员会成长于国家与地方互动的场域,在调解实践中调动、汇聚多方力量及资源,建构出一个调解纠纷的“任务共同体”,形塑了新时代情理法融合的纠纷化解机制。Based on field investigation materials,this paper analyzes the experience and logic of people’s mediation practice in rural society under the background of social transformation.In the practice of mediation,the rural people’s mediation Committee mobilizes and gathers various forces to construct a“task community”of dispute mediation,and forms a dispute resolution mechanism of the integration of reason and law in the new era.
