摘 要:数字时代就是指当下数字技术弥漫社会与法律的时代。它并没有取代“现代”;现代化与现代性的任务或课题,需要我们继续解决。数字时代法学教育有六个观念方面的基本目标。第一,包括四层含义的人文性:以人为目的;与现代社会相一致的公民教育;帮助学生获得人生的意义;对法律、法学与文明、文化关系的恰当认识。第二,包括三方面内容的批判性:多向度、反事实、复杂性。第三,包括四层含义的责任心:对自己的选择承担后果;能够回应社会关切;对法治的责任;对“房间里的大象”具有敏感性。第四,以自由的心灵为条件的创造性。第五,不受数量化和分隔性思维束缚的数字意识。第六,健全的法律思维。同时,数字时代法学教育有三个维度的更为具体的作业目标及结构化的能力目标。我们需要从法学院作业和教师个人教研两个方面实现前述目标。法学院教学方式需要在五个方面进行转变,并办好第二课堂和第三课堂。教师个人一方面要坚守良知与增强专业素养;另一方面要遵循教学规范、提高教研技艺,以适应新时代的要求。The digital age refers to the current era where digital technology pervades society and law.It does not replace the"Modern".Correspondingly,the tasks or issues of modernization and modernity still need to be addressed by us.Legal education in the digital age has six fundamental objectives in terms of conceptions.First,the humanistic aspect,which includes four layers of meaning:being people oriented;civic education consistent with modern society;helping students to gain the meaning of life;and a proper understanding of the relationship between law,legal studies,civilization and culture.Second,the critical aspect,which includes three elements:multi-dimensionality,counterfactuality,and complexity.Third,the sense of responsibility,which includes four layers of meaning:taking responsibility for own choices;being able to respond to societal concerns;having a sense of responsibility for the rule of law;and sensitivity to the"Elephant in the room".Fourth,the creativity conditioned by a free spirit.Fifth,the digital consciousness unfettered by quantification and compartmentalized thinking.Sixth,the sound legal thinking.At the same time,legal education has more specific practice objectives and structured capability objectives in three dimensions.We need to achieve the aforementioned goals from two aspects:the practice of law schools and the individual teaching and research of teachers.The teaching methods of law schools need to undergo transformation in five aspects and to manage the second and third classes well.On the one hand,teachers should adhere to conscience and professional quality;on the other hand,they should follow teaching norms and improve teaching and research skills and crafts to adapt to the requirements of the newera.
