摘 要:《执行异议复议规定》第30条作为预告登记权利人排除强制执行的依据,在具体适用方面存在歧义。实践中,即使预告登记的90日期间已过,登记部门并不会主动注销,仍存有预告登记,此时能否适用第30条的规定排除强制执行,实务意见不一。在梳理预告登记的制度目的及《执行异议复议规定》出台背景的基础上,鉴于我国法律将消费者权益保护作为价值取向之一,在民事强制执行领域也应适度地向不动产消费者倾斜保护。As the basis for excluding mandatory enforcement by the right holder of advance registration,Article 30 of Provisions on Reconsideration of Execution of Objections has ambiguity in its specific application.In practice,the registration department will not actively cancel it and advance registration still exists even if the period of 90 days for advance registration has passed.At this time,various opinions on whether the provisions of Article 30 can be applied to exclude mandatory enforcement appear.Based on the combing of the purpose of the advance registration system and the background of the release of the Provisions on Reconsideration of Execution of Objections,coupled with the inclusion of the protection of consumer rights and interests as one of its value orientations by Chinese law,protection should also be moderately tilted towards real estate consumers in the domain of civil mandatory enforcement.
