环境检察公益诉讼内外部协同与衔接研究

摘　　要：环境检察公益诉讼制度作为生态环境国家保护义务的制度供给之一,位于行政与司法“双轨规制”结构枢纽,应于行政权与司法权的权能参照系中认识其法律监督机关与公益诉讼起诉人的二元身份定位。在外部协同方面,应当在避免架空生态环境损害赔偿诉讼优先顺位、把握环境检察民事公益诉讼专门优势的基础上,着重优化程序衔接;在内部协同方面,除以行政公益诉讼优先为原则外,应当在综合衡量制度功能侧重、公益保护力度的前提下,选择适用行政公益诉讼程序或民事公益诉讼程序。As one of the institutional supplies for the national obligation to protect the ecological environment,the system of environmental public interest litigation by prosecutors is located at the hub of the“dual-track regulation”structure of administration and justice.Its dual identity positioning as a legal supervision agency and a public interest litigation plaintiff should be recognized in the power reference system of administrative power and judicial power.In terms of external coordination,it should focus on optimizing the procedural connection on the basis of avoiding the priority of ecological environmental damage compensation litigation and grasping the special advantages of civil public interest litigation on environment by prosecutors;in terms of internal coordination,in addition to the principle of giving priority to administrative public interest litigation,it should choose to apply administrative public interest litigation procedures or civil public interest litigation procedures on the premise of comprehensively weighing the emphasis of system functions and the strength of public interest protection.
