摘　　要：理论界对我国刑事错案责任追究的探讨由来已久,并在一定程度上促成了一系列制度性尝试。但囿于思想观念转变不及时、体制机制矛盾未解决、网络民意介入较强势等因素,我国的刑事错案责任追究在初始阶段就呈现出泛化和随意化的趋向,同时存在追责难、追责依据不足等较为显著的问题。为有效解决上述问题,亟须健全完善检察机关刑事错案责任追究机制,在理念重塑上体现法治思维和法治方式;在顶层设计上使高位阶立法与司法规范性文件并轨推进;在原则把握上统筹兼顾职业尊荣与自我修复;在程序完善上建立刑事错案责任追究的特别程序;在具体分责上追求客观公平不枉不纵的追责效果;在豁免与救济上慎重追责,体现和完善职业保障。Theoretical circles have been discussing the accountability of misjudged criminal cases in China for a long time,which has led to a series of institutional attempts to a certain extent.However,due to factors such as untimely changes in ideological concepts,unresolved conflicts between systems and mechanisms,and the strong intervention of online public opinion,the accountability of misjudged criminal cases in China has shown a tendency to be generalized and arbitrary at the initial stage.At the same time,there are obvious problems such as the difficulty and the weak basis to hold people accountable.In order to effectively solve the above problems,it is urgent to improve the accountability mechanism of procuratorial organs for misjudged criminal cases,and reflect the legal thinking and legal approach in the reshaping of concepts;in terms of top-level design,high-level legislation and judicial normative documents should be promoted in parallel;in terms of grasping principles,take both professional honor and self-repair into account;in terms of procedural improvement,establish special procedures for the accountability of misjudged criminal cases;in terms of specific allocation of responsibilities,pursue objective,fair and just accountability effects;and in terms of exemptions and relief,carefully pursue accountability and embody and improve job security.
