平台经济数据权益的三重伦理属性

摘　　要：平台经济是数据驱动、平台支撑和网络协同的一种新型经济形态。充分发挥数据要素在平台经济中的作用,需要在尊重数据来源、加工和流动规律基础上,保障数据生产和流通交易过程中各参与方享有的权益,平台经济数据权益集中体现在数据产权、数据流通交易以及数据收益分配等方面。数据归属的正当性体现了数据产权的伦理属性,数据产权既是法律权利又是道德权利,数据归属关系的法律确权是数据产权伦理的体现。数据确权涉及多元数据主体之间基于正义原则的伦理关系;数据交易的平等性体现了数据流通的伦理属性,表现为数据流通交易主体的法律地位和道德地位的平等性、流通交易机会的均等性以及流通交易竞争的公平性;数据收益分配的公平性体现了数据利益的伦理属性,要求遵循按劳分配原则、数据价格合乎市场评价贡献的原则以及数据来源与使用合乎法律规定原则。The platform economy is a new economic model driven by data,supported by platforms and enabled by network collaboration.To fully leverage the role of data elements in this new economic form,it is essential to respect the principles of data sourcing,processing and flow while ensuring that all participants in the production,circulation and transaction of data enjoy their rightful interests.Data rights in the platform economy are primarily manifested in aspects such as data ownership,data circulation and transactions,and the distribution of data-derived benefits.The legitimacy of data ownership reflects the ethical attribute of data property rights which are both legal and moral rights.The legal affirmation of data ownership is an expression of the ethics of data property rights,involving ethical relationships between multiple data subjects based on principles of justice.The equality of data transactions reflects the ethical attribute of data circulation,demonstrated through the legal and moral equality of data transaction participants,equal opportunities in data circulation and transactions,and fairness in competitive trading.The fairness of data distribution reflects the ethical attribute of data-derived benefits,requiring adherence to the principle of distribution according to contribution,the principle that data pricing aligns with market value assessments,and the principle that data sourcing and usage comply with legal requirements.
