摘　　要：营商环境内涵变迁是中国式现代化进程中“权力-权利”二元结构在经济领域更迭与异化的集中展示。通过要素分析并以法治化途径对营商环境进行有效规制,是应对根本矛盾变化、回应人民群众需求以及实现经济治理能力现代化的根本举措。现代化场域下,营商环境的具体内涵已经在价值厘定、主体形态和场域更迭方面发生根本性转变,给社会主义市场经济建设带来了新挑战,“权力-权利”二元结构的失稳凸显了要素发展的不均衡,进一步加剧了政经关系空间发展的非正义性。需要通过多元路径实现“规制权力-保障权利”的结构正义,应设置操作条款与责任条款促进硬法与软法同步建设,通过“主动监督和被动监管”双轨体系构建,为营商环境体制机制的完善提供法治保障。In the process of Chinese modernization,the change of connotation of the business envi-ronment is a centralized demonstration of the change and alienation of the power-rights dichotomy in the economic sphere.Effective regulation of the business environment through factor analysis and the rule of law is a fundamental measure to cope with the changes in fundamental contradictions,which could also respond to the needs of the people and realize the modernization of economic governance capabilities.In the field of modernization,the specific connotation of the business environment has undergone a funda-mental transformation in terms of value definition,subjectivity and field changes,which has brought new challenges to the construction of the socialist market economy.The destabilization of the dichotomy be-tween power and rights has highlighted the uneven development of factors that further exacerbate injustice in the spatial development of political and economic relations.It is necessary to realize the structural jus-tice of the regulation of power and the protection of rights through multiple ways;to set up operational clauses and responsibility clauses to promote the simultaneous construction of hard law and soft law,and provide legal guarantee for the improvement of the business environment system and mechanism through the construction of a dual-track system of active supervision and passive supervision.
