摘　　要：从“法源”角度研究社会秩序有助于理解其骨架,但存在三大盲区:只见“干流”不见“支流”;呈现的多为静态图景,忽视“支”“干”变化的可能;过分强调秩序维护者视角,忽视其他参与者特别是当事人的作用。中国传统社会具体秩序的塑造与四种力量密切相关:法律动员能力、情理动员能力、关系动员能力以及暴力动员能力。这四种力量不断流转、博弈,表面上寻求均衡,实质上掩藏着转化的契机。本文聚焦行动者视角,探讨这四种动员能力及其相生相克、塑造中国传统社会具体秩序的机理。Examining social order from the perspective of the"source of law"aids to understand its framework,but it faces three blind spots:only seeing the"main stream"without seeing the"tributaries";the presented images are mostly static without considering the possibility of changes in"branches"and"stems";overemphasizing the perspective of order maintainers while neglecting the role of other participants,especially the parties involved.The shaping of the specific order in traditional Chinese society is intimately related to four forces:legal mobilization ability,rational mobilization ability,relational mobilization ability,and violent mobilization ability.These four abilities constantly circulate and compete,seeking balance on the surface but hiding opportunities for transformation in essence.This article focuses on the perspective of actors,exploring these four mobilization abilities and their mechanisms of mutual generation and restraint which have shaped the specific order of traditional Chinese society.
