摘 要:仲裁庭自裁管辖权是指仲裁庭对其管辖权享有裁量权。尽管该原则在国际仲裁中广泛适用,却一直未获我国《仲裁法》的明确认可,并被视为我国仲裁与国际仲裁的显著区别之一。我国正在修订《仲裁法》,有望在立法层面正式引入仲裁庭自裁管辖权制度。自裁管辖权的妥当行使与仲裁庭的管辖权问题和争议事项的可受理性问题密切相关,我国立法有必要明确区分“管辖权问题”和“可受理性问题”。我国可借鉴域外仲裁立法和实践的成熟经验,采用“定义加清单”的方式对这两个问题作出规定,并通过相关案例给予裁判方法指引。这不仅有利于指引仲裁庭正确行使自裁管辖权和法院对仲裁庭的相关决定进行司法监督,也有助于将我国建设为国际仲裁优选地。The competence-competence principle means arbitral tribunals shall enjoy authority in ruling on its own jurisdiction.While this principle is widely recognized in international arbitration law and practice,it has not been explicitly recognized in the Arbitration Law of China(CAL).As China is revising the CAL,it is contemplated that this principle will be explicitly legalized in the CAL.Given that the application of this principle is closely related to the issues of arbitral jurisdiction and admissibility of disputes,it is imperative to clearly differentiate between the two issues.It is proposed that China should draw lessons from foreign arbitration laws and practices to explicitly differentiate the two issues,through a“definition plus listing”approach supported by the guidance of guiding cases.This is helpful to the exercise of the competence-competence principle and the supervision thereof,and to the building of China into an attractive arbitral center.
