优化监察机关立案管辖规则的合理路径

摘　　要：在职务违法与职务犯罪“一元”调查程序运行过程中,监察调查与刑事司法在立案管辖规则上存在竞合与冲突。现行监察规范文本存在互涉案件管辖标准欠缺、监察与刑事立案程序衔接不协调与刑事政策衔接不畅的问题。在以监察机关为主导的职务犯罪办案模式中,监察立案管辖规则应恪守监察调查的二元主义立场。以监察调查主体的内部分工为原则,立法应认可并案管辖规则所具备的效率价值,严格区分主动并案和强制并案规则的适用边界。结合立案管辖的“条块模式”,立法应明确“分案管辖”中不同管辖主体之间的主从配合义务。同时,立案管辖规则的立法完善首先应明确互涉案件并案规则的一般情形及其例外,探索构建监察立案管辖异议的救济程序,对监察立案的追究时效予以类型化设定。In the running process of the unitary investigation procedure between duty violation and duty crime,there is competition and conflict between supervision investigation and criminal justice in the jurisdiction rules of filing a case.There are some problems in the current regulatory texts of supervision,such as the lack of jurisdiction standards for related cases,the uncoordinated connection between supervision and criminal filing procedures,and the corresponding obstacles in the connection and application of criminal policies.In the case-handling mode of duty crimes led by supervisory organs,the rules of supervision and filing jurisdiction should strictly abide by the dualistic position of supervision and investigation.Based on the principle of supervising the internal division of labor of the investigation subjects,legislation should recognize the efficiency value of the joint jurisdiction rules,and strictly distinguish the applicable boundary between the active and compulsory joint jurisdiction rules.Combined with the “compartmentalized mode” of case-filing jurisdiction,legislation should clarify the duty of cooperation between master and slave among different jurisdictions in “divisional jurisdiction”.At the same time,the legislative perfection of the rules of filing jurisdiction should first clarify the general situation and exceptions of the rules of merging cases involving each other,explore the relief procedure for the jurisdictional objection of supervision filing,and set the limitation of investigation for supervision filing.
