摘　　要：自贸区是我国经济高速发展的助推器,自贸区临时仲裁制度的构建有利于优化自贸区营商环境、提升自贸区法治化治理水平,亦有助于实现我国对外开放的国家发展战略。以黑龙江自贸区为例,通过实证分析方法阐释自贸区构建临时仲裁制度的必要性;通过分析自贸区临时仲裁制度面临的立法及实践困境,从立法规划、规则细化、司法监督三个维度探求破局之法。2024年,全国人大将正式审议《中华人民共和国仲裁法》的修订,在此时代背景下提出了明晰立法模式以破除合法性障碍、细化临时仲裁员选任、明确其责任承担、完善司法监督与保障等具体措施,以期推进黑龙江自由贸易区临时仲裁制度的构建与发展,为临时仲裁在全国范围的适用贡献黑龙江智慧,为优化营商环境和促进开放提供法治方案。Free trade zones are the driving force for China’s rapid economic development.The establishment of a temporary arbitration system in free trade zones is conducive to optimizing the business environment of free trade zones,improving the level of legal and modern governance in free trade zones,and also helping to achieve China’s national development strategy of opening up to the outside world.Taking the Heilongjiang Free Trade Zone as an example,this paper uses empirical analysis methods to explain the necessity of establishing a temporary arbitration system in the Free Trade Zone;By analyzing the legislative and practical difficulties faced by the temporary arbitration system in free trade zones,this study explores ways to break through the impasse from three dimensions:legislative planning,rule refinement,and judicial supervision.In 2024,the General of the National People’s Congress formally reviewed the revision of the Arbitration Law,and proposed specific measures to clarify the legislative model,remove legal barriers,refine the selection and appointment of temporary arbitrators,clarify their responsibilities,improve judicial supervision and security,etc.,in order to promote the construction and development of the temporary arbitration system in Heilongjiang Free Trade Zone,contribute Heilongjiang wisdom to the application of temporary arbitration nationwide,and provide a rule of law solution for optimizing business and promoting openness.
