从“个人自主”到“关系自主”:现代公民隐私观念的关系性转向

摘　　要：隐私作为一项独处、不受外界干涉及他人打扰的个人权利,有着深厚的传统自由主义思想渊源。随着新兴技术的快速发展与广泛应用,传统以个人自主为基础的隐私观念在现今大数据、人工智能等媒介技术的作用下,其自我的“二元分裂”、认知的“涣散”、主体性的“消解”,使得强调与他人分离、主张他人与社会分隔来保护隐私的观念,难以回应现今隐私保护的诉求。一方面,媒介技术对自我认知的重塑直接影响公民对隐私的认识和理解,需要重新审视数字化时代的隐私;另一方面,公民需要警惕和正视来自外部异化了的各方势力对自我评价的冲击。从关系性的视角出发对现代隐私保护模式进行建构,尊重关系自主,在社会参与中重塑自我,在社会互动中实现自主,进而强化公民作为人的主体意识,激发个人的想象力和创造力,推动社会的创新发展,促使公民能够在社会化生存与个人的自由化发展之间寻求恰当的平衡。Privacy,as a personal right to solitude,free from external interference and others disturbance,has deep roots in traditional liberal thought.With the rapid development and widespread application of emerging technologies,the traditional privacy concept based on individual autonomy faces challenges in today s context of big data and artificial intelligence.These technologies cause a“binary split”of self,“dispersion”of cognition,and“dissolution”of subjectivity,making it difficult to address current privacy protection needs with the old notion of separating oneself from others and society to protect privacy.On one hand,media technology s reshaping of self-perception directly affects citizens understanding and comprehension of privacy,necessitating a reevaluation of privacy in the digital age.On the other hand,citizens must be vigilant and acknowledge the impact of external,alienating forces on their self-assessment.This article constructs a modern privacy protection model from a relational perspective,emphasizing relational autonomy.It suggests reshaping the self through social participation and achieving autonomy through social interaction,thereby strengthening citizens subject consciousness as individuals,stimulating personal imagination and creativity,promoting social innovation,and enabling citizens to find an appropriate balance between socialized existence and individual liberal development.
