论监检衔接下被调查人言词证据的转化

摘　　要：在被调查人言词证据从监察阶段到审查起诉阶段的转化过程中,监察机关和检察机关在证据收集和审查上存在衔接不顺畅之处。监察机关收集的被调查人言词证据跨越初步核实和调查阶段,包括违纪、职务违法、职务犯罪三类案件。因不同阶段、不同案件对证据的取证措施、取证标准等存在差别,对于监察机关收集的被调查人言词证据,不应直接按照《监察法》第33条的规定认定其具备刑事证据资格,而应当区分阶段、案件类型进行准确认定,限制部分被调查人言词证据的刑事诉讼准入资格;完善监察机关内部机构设置,使监察证据审查具备中立性,保证被调查人言词证据的证据质量;同时构建检察机关对被调查人言词证据的确认式审查模式,明确被调查人言词证据在审查起诉阶段中的使用方法。从而使监检之间在被调查人言词证据的转化上能够顺畅衔接。In the process of transforming the verbal evidence of the investigated person from the supervision stage to the examination and presecution stage,There is lack of smooth coordination between the supervisory and prosecutorial organs in the collection and review of the evidence.The verbal evidence collected by the supervisory authorities from the investigated person,crossing the preliminary verification and investigation stage,including violation of discipline,violation of offical duties,and official crimes.Due to different stages and cases,there are differences in the measures and standards for collecting evidence.Regarding the verbal evidence collected by the supervisory authorities from investigated individuals,it should not apply to Article 33:It is determined that they have the qualifications for criminal evidence in Supervision Law.It should distinguish stages and accurately identify the type of the case.It should restrict the criminal procedure access qualification for verbal evidence of some investigated individuals and promote the internal organizational structure of the supervisory organs,which ensures the neutrality of supervisory evidence and the quality of verbal evidence provided by the investigated party.Simutaneously establish a confirmation based review model for the oral evidence of the investigated person by the procuratorial organs.It clarify the use of verbal evidence by the investigated person during the revies and presecution stage so as to enable smooth connection between supervison and inspection in the conversion of verbal evidence of the investigated person.
