摘 要:随着工业化和城镇化的推进,宅基地闲置问题愈加严重,传统的宅基地使用权制度亟待改善。宅基地“三权分置”的立法确认,使得闲置宅基地使用权入股成为一种新的流转方式。通过对闲置宅基地使用权入股的制度梳理及实践考察,发现其存在法律规定分散且不健全、评估作价标准有缺陷、收益分配制度不完善及破产处置方法有风险的问题。应在明确闲置宅基地使用权入股所遵循的原则下,发挥宅基地的经济价值,提高农民财产收益,助力乡村振兴。With the advancement of industrialization and urbanization,the problem of idle residential land has become more and more serious,and the traditional system of residential land use right needs to be improved.The legislative confirmation of"three rights separation"of residential land has made idle residential land use right as stock shares become a new way of circulation.Through combing the institution and practical investigations of the right to use idle residential land for stock purchase,it is found that there are such problems as the legal provisions scattered and unsound,the price of shares and evaluation standard defective,the income distribution system imperfect and the bankruptcy disposal at risk.This paper suggests that the institution should be improved in terms of establishing systematic legal norms,formulating scientific evaluation standards,innovating the income distribution system and setting up a bankruptcy risk prevention system under the required principles of clarifying the idle residential land use right as stock shares.Thus,the economic value of the residential land can be realized,the property income of farmers can be improved and the rural revitalization get aided.
