摘 要:伴随着司法证据制度、科技以及认知水平的每一次变革或进化,司法证明过程几乎都会出现不同形式和程度的量化尝试。数字化在法律体系中的预期功能有度量功能、识别功能、运算功能。新证据学研究对数学与证明相结合的探讨,引发了对法庭认识论及证据理论基础的反思,这影响了此后事实认定数字化的发展。计算机决策模型与统一证据标准数据化同属事实认定数字化趋势,二者都是对新证据学研究数学裁判路径的批判与承继。对计算机决策模型的研究有助于对统一证据标准数据化范式及改革逻辑的梳理分析。统一证据标准数据化改革内容包括:数字化度量基础,统一证据标准的规范化;数字化识别成效,将统一证据标准镶嵌到数据化程序的过程中;数字化运算实践,实现司法专门化技术培育,破除人工智能技术本身的发展限制,应对司法人工智能化的实质性证立问题。With change and evolution in the judicial evidence system,technology and cognitive level,the judicia proof process will almost always undergo quantitative attempts in different forms and degrees.The expected functions of digitization in the legal system include measurement,identification,and computation.The exploration of the combination of mathematics and proof in the new evidence research has triggered the reflection of the court epistemology and the theoretical basis of evidence theory,which has affected the development of factual identification digitization.The computer decision model and the unified evidence standard data both belong to the digitalization trend of fact identification,and both of them are the criticism and inheritance of the mathematical judgment path of the new evidence research.The study of computer decision models helps to sort out and analyze the data paradigm and reform logic of unified evidence standards.The content of the unified evidence standard data reform includes:digital measurement basis,the standardization of unified evidence standard;the effect of digital identification,embedding the unified evidence standard into the data procedure;digital computing practice,realizing the cultivation of judicial specialized technology,breaking the development restrictions of artificial intelligence technology itself,and dealing with the substantive justification issues of judicial artificial intelligence.
