摘　　要：科学理解金融刑法的构造、厘清金融犯罪认定中的行刑分界具有重要意义。我国金融刑法规范具有立法体例上的统一性、罪状设置上的从属性、构成要件上的短缩性、保护法益的管理性和部分条款的超前性等特点。金融犯罪的行政从属性与构成要件短缩性使得部分金融领域违法犯罪行为的行刑分界存在模糊性。对金融犯罪侵害法益管理性的过分强调不利于一般金融违法行为与金融犯罪的实质区分,部分金融犯罪案件的认定可能与法秩序统一性存在背离。科学理解与厘清金融违法犯罪行为的行刑分界,可以继续采取统一的刑事立法体例,对采取短缩构成要件类型的金融犯罪认定应保持限制立场。此外,区分金融犯罪与一般金融违法行为,应当贯彻法秩序统一性原理,并以对金融秩序法益的科学理解指导对金融犯罪的实质解释。It is of great significance to scientifically understand the structure of financial criminal law and the boundary between administrative law and criminal law in the identification of financial crimes.Chinese financial criminal law standards have the characteristics of unity in legislative style,subordination in the setting of crimes,shortening in types of constituent elements,management in protecting legal interests,and advances of some clauses.The administrative subordination and the shortened types of constituent elements in the establishment of financial crime crimes make the boundary between administrative law and criminal law in the financial field ambiguous.The administrative nature of infringement of legal rights is not conducive to the substantive distinction between financial violations and financial crimes.At the same time,the handling of some financial criminal cases ignores the requirements of the unity of law and order.To scientifically understand and identify the boundaries between administrative law and criminal law for financial violations,we can continue to adopt a unified criminal legislation model,and maintain a restrictive stance on legislative techniques that shorten the types of constituent elements.Besides,the identification of financial crimes should implement the principle of the unity of legal order,and use a scientific understanding of the legal interests of order to guide the substantive interpretation of financial crimes.
