摘　　要：金融犯罪的保护法益决定了金融刑法的规制面向。随着金融犯罪形式日益复杂,法益一元论已难以满足金融犯罪治理的新需求。金融风险的系统性、金融安全保护的迫切性都表明法益二元论更符合当前的金融形势。在构建法益二元论时,须明确金融刑法的理念,即防范金融风险并不意味着消除一切金融风险,仍需要为金融创新提供一定的空间。金融秩序和金融自由也并非绝对对立,而是相互依存的。由于肯定秩序法益在一定程度上会加剧法益保护前置化的倾向,招致金融刑法适用泛化的质疑,因此,在立法层面有必要引入比例原则检视金融犯罪的规定,在司法层面作出类型化的区分,合理确定金融犯罪的边界,从而保障金融市场的健康发展。The protection of legal interests in financial crimes determines the regulatory orientation of financial criminal law.With the increasingly complex forms of financial crimes,the monism of legal interests is no longer sufficient to meet the new needs of financial crime governance.The systemic nature of financial risks and the urgent need for financial security protection both indicate that the dualism of legal interests is more in line with the current financial situation.When constructing the dualism of legal interests,the first thing to clarify is the concept of financial criminal law,that is,preventing financial risks does not mean eliminating all financial risks,and still needs to provide some space for financial innovation.Financial order and financial freedom are not absolute opposites,but interdependent.Due to the fact that affirming the legal interests of order will to some extent exacerbate the tendency of prioritizing the protection of legal interests,it has raised doubts about the generalization of the application of financial criminal law.Therefore,it is necessary to introduce the principle of proportionality at the legislative level to examine the provisions of financial crimes,make typological distinctions at the judicial level,reasonably determine the boundaries of financial crimes,and ensure the healthy development of the financial market.
