摘 要:全球化背景下,向世界展示中国法治建设的成就离不开《民法典》的翻译。基于对《民法典》合同编的两个英译本——人大版和西政版进行深入的对比分析,聚焦译文中修辞策略的应用及其对表达效果的影响,揭示两个版本在修辞运用上的显著差异。研究结果表明:无论是人大版还是西政版,都在不同程度上利用了强调重要信息、优化语言表达、强化逻辑结构等修辞策略。人大版多采用首语重复、排比等较为保守的修辞技巧,以保障法律文本的正当性和权威性;而西政版则在修辞上展现出更大的多样性和创造性,广泛运用顶真、倒装等翻译手法,旨在提升文本的可读性。从修辞策略的角度对《民法典》的翻译进行了初步研究,以期为法律文本的修辞翻译提供参考和借鉴。In the context of globalization,the translation of the Civil Code is a crucial step in demonstrating the advancements China has made in the realm of rule of law to the international community. This paper conducts an in-depth comparative analysis of the two English translations of Contracts of the Civil Code, the NPC version and the Southwest University of Political Science and Law(SWUPL) version, focusing on the application of rhetorical strategies in the translation and their impact on the expression functions and revealing significant differences in the use of rhetoric between the two versions. It is found that both the NPC version and SWUPL version employ rhetorical strategies to varying degrees to emphasize important information, improve linguistic expression and reinforce logical structure. The NPC version mostly adopts conservative rhetorical techniques such as anaphora and parallelism to maintain the formality and authority of the legal text, while the SWUPL version shows greater rhetorical diversity and creativity, making extensive use of anadiplosis, anastrophe and other strategies, with the aim of enhancing the readability of the text. This paper presents a preliminary study on the translation of the Civil Code in terms of rhetorical strategies, hoping to provide a reference for the rhetorical translation of legal texts.
