摘　　要：以80起医疗事故罪案例作为样本,探究影响我国医疗事故罪判决结果的因素,并利用结构方程模型深入分析影响判决结果的内在机理。结果显示:是否死亡、鉴定类型、民事赔偿、违反诊疗规范和取得被害一方谅解对判决结果的影响具有统计学意义;根据总效应值,对判决结果影响从大到小依次为:违反诊疗规范、取得被害一方谅解、是否死亡、鉴定类型;违反诊疗规范对判决结果具有最强的正向直接效应,取得被害一方谅解对判决结果具有最强的负向间接效应。在当前的司法体系下,被告人是否违反诊疗规范、是否通过经济补偿来取得患方的谅解显著影响着医疗过失刑事判决的走向。This study examines the factors influencing judicial outcomes in medical malpractice criminal cases in China based on an analysis of 80 sample cases,and employs structural equation modeling to deeply analyze the underlying mechanism affecting the verdict outcomes.The results indicate that factors such as the occurrence of death,the type of forensic evaluation,civil compensation,violation of diagnostic and treatment norms,and obtaining the victim's forgiveness have statistically significant impacts.The factors,ranked by their total effect on the outcomes,are:violation of diagnostic and treatment norms,obtaining the victim's forgiveness,occurrence of death,and the type of forensic evaluation.Violation of diagnostic and treatment norms exerts the strongest positive direct effect on the outcomes,while obtaining the victim's forgiveness has the strongest negative indirect effect.These findings suggest that under the current judicial system,whether the defendant violated diagnostic and treatment norms and whether they gained the victim's forgiveness through financial compensation significantly influence the direction of criminal judgments in medical malpractice cases.
