医疗企业反商业贿赂合规体系构建研究

摘　　要：医疗企业商业贿赂现象频发,现有规则体系和机制难以应对高要求的合规标准。因此,在医疗企业引入反商业贿赂合规势在必行。当前医疗企业合规建设在我国已初见端倪,但由于合规理念有待深入普及、现有合规体系难以应对法律的复杂多变、合规建设成本与企业预期投入不符且处于合规管理体系建设初期,以风险为导向的合规建设并非最优选择。与之相比,建立以管理为导向的合规体系在有效降低合规建设成本、增强合规建设积极性并提高合规实施成效等方面优势显著。具体而言,可以从决策、组织、领导、控制、创新方面进行以管理为导向的合规体系构建。The phenomenon of commercial bribery in medical enterprises is widespread,and the current regulatory system and mechanisms struggle to meet the high standards required for compliance.Therefore,introducing anti-commercial bribery compliance in medical enterprises is imperative.While some initial progress has been made in compliance construction in China's medical enterprises,several challenges remain.These include a lack of widespread understanding of compliance concepts,existing compliance systems being unable to cope with the complexity and variability of legal requirements,and the mismatch between compliance costs and expected investment in enterprises,all of which place compliance management in its early stages.As a result,a risk-oriented approach to compliance may not be the best option.In comparison,establishing a management-oriented compliance system offers significant advantages in effectively reducing compliance construction costs,enhancing enthusiasm for compliance,and improving compliance implementation effectiveness.Specifically,a managementoriented compliance system can be built through decision-making,organization,leadership,control,and innovation.
