点播终端提供网上视听作品行为的定性--基于著作权侵权认定的方法论  

Characterization of the Act of Providing Online Audiovisual Works via On-Demand Terminals—A Methodological Approach to Determine Copyright Infringement

摘　　要：“少而宽”立法模式下的著作权侵权认定,可以解释法定权利的保护范围将新的传播行为纳入规制;“多而窄”立法模式应采用严格依据法定权利认定著作权侵权的方法论,中国《著作权法》是该种模式的典型代表。实现严格依据法定权利认定著作权侵权的方法论,应该坚持不在法定权利类型之外和不扩大解释具体法定权利提供著作权保护。通过点播终端提供网上视听作品的行为不符合信息网络传播权控制行为所必须具备将作品上传网络的技术特征,也不符合放映权通过放映设备与片源控制放映的技术特征。因此,通过点播终端提供视听作品的行为并不构成信息网络传播权和放映权的直接侵权。The determination of copyright infringement under the legislative model of"few and wide"can explain the scope of protection of the statutory rights to include new acts of dissemination into the regulation,and the legislative model of"many and narrow"should adopt the methodology of determining copyright infringement strictly based on the statutory rights,and China's Copyright Law is a typical representative of this model.To realize the methodology of de⁃termining copyright infringement strictly based on the statutory rights,it should be insisted that copyright protection should not be provided outside the types of the statutory rights and without expanding the interpretation of specific legal rights.The act of providing online audiovisual works through on-demand terminals does not conform to the techni⁃cal characteristics of uploading works to the network that are necessary for controlling the act of the right of communi⁃cation via information network,nor does it conform to the technical characteristics of the right of projection that is to control the projection through the projection equipment and the source of the film.Therefore,the act of providing audio-visual works through on-demand terminals does not constitute a direct infringement of the right of communica⁃tion via information network and the right of projection.
