摘　　要：司法通过明确“有利于查清犯罪事实、有利于诉讼的原则”以及对犯罪地的扩张解释、大量的指定管辖和并案处理等鼓励侦查机关及时侦破案件,但也带来了网络案件管辖混乱、侦查管辖与审判管辖错位等问题。反思管辖问题的相关理论和体系,在检视管辖制度的价值和实现路径的基础上,通过建立网络犯罪数据共享平台、推行“三统两分”的一揽子解决方案、明确指定管辖的审查规则以及加强并案处理的检察监督等,以有效保障网络犯罪司法活动的合法、有序开展。The popularization of the Internet and the upsurge of cybercrime have brought new challenges to criminal justice.Judiciary has responded to this urgent demand by encouraging the investigation organs to investigate cases in a timely manner by clarifying the"principles that are conducive to the investigation of criminal facts and to litigation",expanding the interpretation of the place of crime,and processing a large number of cases by designated jurisdiction or in a concurrent manner,but its practices have also brought about problems such as the confusion of the network case jurisdiction,and the mismatch between the investigation jurisdiction and the trial jurisdiction.On the basis of clarifying the specific content of China′s existing criminal jurisdiction rules,reflecting on the relevant theories and systems of jurisdiction issues,and reviewing the values and implementation path of the jurisdiction system,this paper proposes to establish a network crime data sharing platform,implement a package solution of"three unifications and two separations",specify the review rules of jurisdiction,and strengthen the procuratorial supervision of concurrent processing of cases,so as to effectively ensure the legal and orderly development of the judicial management of cybercrime.
